1. Acceptance of Terms
By accessing and using HeberMax services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Service Description
HeberMax provides web hosting, domain registration, SSL certificates, and related digital services. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice to customers.
3. Account Registration
You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.
4. Acceptable Use Policy
You agree not to use our services for any unlawful purpose or in any way that might harm, damage, or disparage HeberMax or any third party. Prohibited activities include but are not limited to: spamming, malware distribution, phishing, copyright infringement, or hosting illegal content.
5. Payment Terms
All fees are payable in advance and are non-refundable except as expressly provided in our refund policy. You authorize HeberMax to charge your payment method for all fees. We reserve the right to change our fees with 30 days notice.
6. Service Level Agreement
HeberMax guarantees 99.9% uptime for hosting services. In the event of downtime exceeding this threshold, eligible customers may receive service credits as outlined in our SLA documentation.
7. Data Security
We implement industry-standard security measures to protect your data. However, you acknowledge that no method of transmission over the internet is 100% secure, and you use our services at your own risk.
8. Backups
While we perform regular backups of our systems, you are solely responsible for maintaining your own backups of your data and content. HeberMax is not liable for any data loss.
9. Termination
Either party may terminate this agreement at any time. HeberMax reserves the right to suspend or terminate accounts that violate these terms. Upon termination, you must immediately cease use of our services.
10. Limitation of Liability
HeberMax's total liability to you for any damages shall not exceed the amount you paid for services in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
11. Indemnification
You agree to indemnify and hold HeberMax harmless from any claims, damages, losses, or expenses arising from your use of our services or violation of these terms.
12. Changes to Terms
We reserve the right to modify these terms at any time. We will notify you of significant changes via email or through our service. Your continued use of our services after changes constitutes acceptance of the new terms.
